Oh there's always hyperbole and chicken littling... but the RIAA also sucks and overreacts, and I'm not sure that I would like things left up to their discretion.
Speaking of screwing up... what was up with Megaupload last night? None of the links were working and when I googled I got that they're under Denial of Service attack.
But it's NOT left up to RIAA's discretion. It's left up to a federal judge's discretion, after the AG or a copyright holder (which would actually be the individual record company, not RIAA) makes a case that they meet the definition of an infringing site as specified in the legislation, which has a fairly high burden of proof.
We're nearly always on the opposite side from RIAA, because they like to screw us over just as much as they screw over consumers. :-P I think the fact that we ARE on the same side on this issue says a lot.
This is the first I've heard about Megaupload, but from googling, it sounds like it's completely unrelated to ICE seizures and should be back up and running.
Oh, I wasn't thinking it was ICE, just that it was weird and irritating last night because I was trying to download Being Erica and I usually use Megaupload.
