I haven't made a post about it in my LJ, and I don't know that I will.  I am, however, passing along a link (to some other links) that I found interesting.  The comments and counter-arguments are interesting as well, and at least in these debates there's some effort for logic (on both sides) rather than simple appeals to emotion (and when it comes to these things, I tend to lean more towards cold logic than impassioned expressions of emotion.  It's a personality-type thing.)

P.S.  -- Seriously, fandom, cat macros are not the way for fandom to make its argument.  Please use full sentences.

I read that second article a couple of days ago, and there were a lot of good points made in it. Unfortunately, his understanding of the legal issues is just plain wrong, and I hate to see that sort of misinformation spread about.

I think he has a point insofar as fandom desperately trying to bring more attention to itself may not be in fandom's best interest over the long haul. The more attention is focused on fandom's activities, the more it may provoke others with counter-agendas to work against them.

Also, I think that fandom wishes 6A to make explicit statements of what they will and won't allow, and I think that this is something that 6A's lawyers will never, ever allow them to do, so fandom needs to choose another tactic if they want to yeild any results.

Oh, and I suppose that a part of my feelings of wariness that "fandom shouldn't try to draw too much attention to itself" harkens back to my days in the XF fandom, where Fox would, generally, ignore folks. But, if you became too in your face about it (being so bold as to post on Fox's forums about it, linking it on Fox's forums, etc.), you'd fairly immediately be served with "cease and desist" letters. There was more wiggle room with fiction, but they were quick to send out letters of "pull those pictures down NOW!" (And it was based simply in their being pictures, not at all a question of obscenity. Just copyright.)

Being my first experience with fandom, it's gone a long way toward setting my sense of what one can most probably get away with. Text gets away with more than pictures, and it's never good to shout about yourself too loudly outside of fandom itself. I find it difficult to shake that sense of boundary and have in fact found what fandom can get away with more lenient NOW than when I first found fanfiction and fan art over a decade ago.
